These Terms of Service govern your use of storiedrugs.com and any purchase you make from Storied Rugs. By visiting our site or placing an order you agree to be bound by these terms. Please read them carefully.

1. Overview

This website is operated by Storied Rugs ("we", "us", "our"), 4189 Cambie St, Vancouver, British Columbia V5Z 2Y2, Canada. Throughout the site, these terms apply to all users, including browsers, customers and contributors of content. If you do not agree to these terms, please do not use this site or purchase from us.

Any new features or tools added to the store are also subject to these Terms of Service. We reserve the right to update or replace any part of these terms by posting a revised version on this page. Your continued use of the site after changes are posted constitutes acceptance of those changes.

2. Store terms

By agreeing to these terms you confirm that you are at least the age of majority in your province, state or territory of residence. You may not use our products for any unlawful purpose, nor may you violate any laws in your jurisdiction (including copyright laws) in using our service. A breach of these terms will result in immediate termination of access.

3. Our products

Every rug we sell is a one-of-a-kind vintage or antique piece. Each is decades old, hand-knotted, and has been cleaned and restored by hand before listing. Because of this:

• No two rugs are identical, and no rug can be reordered or replaced with a matching piece.
• Dimensions are measured by hand and are approximate. Hand-knotted rugs are rarely perfectly rectangular and minor variation in length and width is normal.
• Colours may appear differently on your screen than in person. Screen calibration, lighting and photography all affect how a rug looks online. We photograph every rug in natural light and show multiple angles, but we cannot guarantee that your display reproduces colour exactly.
• Signs of age, wear, patina, low pile in places, small repairs and slight irregularities are inherent to vintage rugs and are not defects. Where a piece has notable wear we describe it on the product page.

We reserve the right to limit the quantities of any products we offer, to discontinue any product at any time, and to refuse any order at our sole discretion.

4. Pricing and payment

All prices are listed in Canadian dollars (CAD) unless stated otherwise, and are subject to change without notice. Applicable taxes and duties are calculated at checkout or may be payable on delivery depending on your destination.

You agree to provide current, complete and accurate purchase and account information for every purchase. We reserve the right to refuse or cancel any order, including where we suspect the order was placed by a dealer, reseller or distributor, or where a price or product description has been listed in error.

5. Shipping and delivery

Shipping is free and fully insured across North America, with no minimum order. Orders are processed within one to four business days and most arrive within about ten days. Delivery beyond North America is available on request and quoted individually before you commit. Full details are set out on our Shipping & Returns page, which forms part of these terms.

6. Returns and refunds

If a rug is not right for your space, contact us within 7 days of delivery to arrange a return. Return shipping is arranged and paid by the buyer. Once the rug arrives back with us and passes inspection, we refund to the original payment method. Our full Refund Policy forms part of these Terms of Service.

7. Accuracy of information

We make every effort to describe each rug accurately, including its origin, age, materials and condition. Attribution of vintage rugs to a specific region or weaving tradition reflects our professional judgement based on construction, materials and design, and is offered in good faith rather than as a certified guarantee. Age is estimated from the same evidence.

We are not responsible if information on this site is not accurate, complete or current. Material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information.

8. Prohibited uses

In addition to other prohibitions set out in these terms, you are prohibited from using the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations, rules or laws; to infringe upon our intellectual property rights or those of others; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload viruses or any code that will affect the functionality of the site; to collect or track the personal information of others; to spam, phish, crawl or scrape; for any obscene or immoral purpose; or to interfere with the security features of the site.

9. Intellectual property

All photography, written descriptions, editorial content and design on this site are the property of Storied Rugs and are protected by copyright. You may not reproduce, distribute or use our product photography or written content for commercial purposes without our written permission.

10. Third-party links

Content available through this service may include material from third parties. Third-party links may direct you to sites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any third-party materials, websites, products or services. Please review third-party policies and practices carefully before entering into any transaction with them.

11. User submissions

If you send us comments, suggestions, reviews, photographs or other submissions, whether at our request or unsolicited, you agree that we may use, edit, copy, publish and distribute them in any medium without restriction and without obligation to compensate you. We may, but have no obligation to, monitor, edit or remove content we determine to be unlawful, offensive, defamatory or otherwise objectionable.

12. Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

13. Errors and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors, and to change or update information or cancel orders, at any time without prior notice, including after you have submitted your order.

14. Disclaimer and limitation of liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. Except as expressly stated by us, the service and all products delivered to you through it are provided "as is" and "as available" for your use, without any representation, warranty or condition of any kind, express or implied, including all implied warranties of merchantability and fitness for a particular purpose, other than those that cannot be excluded under applicable law, including the Business Practices and Consumer Protection Act (British Columbia) and the Sale of Goods Act (British Columbia).

To the extent permitted by law, Storied Rugs and its suppliers and service providers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the site or any products purchased through it. Where liability cannot be excluded, our liability is limited to the amount you paid for the product in question.

15. Indemnification

You agree to indemnify and hold harmless Storied Rugs and our affiliates, officers, contractors and employees from any claim or demand, including reasonable legal fees, made by any third party due to your breach of these Terms of Service or your violation of any law or the rights of a third party.

16. Severability

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

17. Termination

These terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our service, or by ceasing to use the site. If in our sole judgement you fail to comply with any term of this agreement, we may terminate it at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

18. Entire agreement

These Terms of Service, together with any policies posted on this site, constitute the entire agreement between you and Storied Rugs and govern your use of the service, superseding any prior agreements or communications. Our failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

19. Governing law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

20. Changes to these terms

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these terms by posting updates to our website. It is your responsibility to check this page periodically for changes.
